Terms and Conditions for the OkO BH Online Store

These terms and conditions provide information about the sales agreements entered into by the sole proprietorship operating under the name OKO Beauty Hunter Limited Liability Company in Warsaw, NIP: 8992932678 Regon: 522746764 KRS 0000985628 Ul. Obrzeżna 7a/U10 02-691 Warsaw, Poland through the online store oko.bh.pl (hereinafter referred to as the "Online Store"), and include key information about the Seller, the store, and the Consumer's rights.


§1 Definitions

  • Consumer – A Consumer as defined by the Civil Code.
  • Buyer – Any entity purchasing through the Store.
  • Terms and Conditions – These terms and conditions.

  • Store – The OkO BH online store operated by the Seller at the website address oko.bh.pl.
  • Seller – OKO Beauty Hunter Limited Liability Company, based in Warsaw, at Obrzeżna 7A/U10, 02-691 Warsaw, NIP 8992932678, REGON 522746764.
  • Product – The minimum and indivisible quantity of goods that may be ordered, as indicated in the Seller's store as the unit of measure when determining its price (price/unit).
  • Client – An adult natural person with full legal capacity, a legal person, or an organizational unit without legal personality but with legal capacity, who makes a purchase from the Seller directly related to their business or professional activity.
  • Sales Agreement – A sales agreement concluded remotely, under the terms specified in these Terms and Conditions, between the Client and the Seller.
  • Order – The Buyer's declaration of intent submitted via the store, specifying unequivocally: the type and quantity of products; the type of delivery; the type of payment; the place of delivery; and the Buyer's data, aimed directly at concluding a contract between the Buyer and the Seller.
  • Subject of the Agreement – The products and delivery that are the subject of the agreement.
  • Business Days – Days from Monday to Friday, excluding public holidays.
  • GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.
  • Delivery Time – The number of hours or business days specified on the product page.
  • Defect – Both a physical defect and a legal defect.

§3 Agreement Conclusion and Execution

  • The Agreement is concluded in Polish in accordance with Polish law and these Terms and Conditions.
  • The prices of goods displayed in the Store are total prices in Polish zlotys, including VAT.
  • Placing an order is equivalent to concluding a sales agreement between the Buyer and the Seller.
  • Browsing the store's assortment and placing an order does not require an account; however, providing personal and address details of the Buyer is necessary to process the Order.
  • To place an order, the Buyer should perform the following actions: 1) select a product; 2) add the product to the cart; 3) select the delivery method; 4) select the payment method; 4) place the order by using the "Order and Pay" button, thereby confirming the order.
  • To place an order, it is necessary to accept the content of the Terms and Conditions and provide personal data marked as mandatory.
  • The Agreement with the Consumer is concluded at the moment of order confirmation.
  • The product will be sent by the delivery method chosen by the Buyer to the address specified by the Buyer.
  • Orders can be placed 24 hours a day.
  • During the ordering process, until the "Order and Pay" button is pressed, the Buyer can modify the Order.
  • After the Buyer provides all the necessary information for the Order and confirms the Order by clicking the "Order and Pay" button, the Buyer will be informed by email about the conclusion of the Agreement and will receive information about the Subject of the Order, quantity, payment method, and delivery method.
  • The Seller is not responsible for incorrectly provided electronic addresses and the failure of the Client to receive messages due to this.
  • The order fulfillment time is up to 2 business days, with the product being shipped no later than the next business day.


§4 Pricing and Delivery Time

  • Delivery of the Goods is possible within the territory of the Republic of Poland and abroad.
  • The delivery time depends on the operator chosen during the ordering process:
  • Via InPost Courier: 14 PLN
  • InPost Parcel Lockers: 13 PLN – the parcel waits in the Parcel Locker for 2 calendar days. You will then receive a notification about the transfer of the shipment to the nearest InPost Branch. After 11 days, the parcel will be returned to the sender. After 24 hours from the parcel's delivery to the Parcel Locker, you will receive an SMS and email reminder that only 48 hours remain to pick up the parcel.
  • International delivery is carried out via FedEx courier, with a delivery fee within the EU of 70 PLN.
  • Payments are processed through the Przelewy24 system.
  • The payment card operator is PayPro SA Settlement Agent, Kanclerska 15, 60-327 Poznań, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court Poznań Nowe Miasto and Wilda in Poznań, VIII Commercial Division of the National Court Register under number KRS 0000347935, NIP 7792369887, REGON 301345068.


§5 Right to Withdraw from the Agreement

  • The Consumer has the right to withdraw from the agreement concluded with the Seller via the Store within 14 days without providing any reason.
  • The deadline to withdraw from the Sales Agreement expires 14 days after the day the Client took possession of the Goods or on which a third party other than the carrier and indicated by the Client took possession of the Goods.
  • Refunds are made using the same payment methods that were used by the Client in the original transaction. The refund period may extend up to 14 business days.
  • To exercise the right of withdrawal, the Consumer must inform the Store of their decision to withdraw from the Agreement.
  • The Consumer bears no costs for exercising the right to withdraw from the contract, except for the direct costs of returning the goods to the Store.
  • The returned Product must not show signs of use, must not be damaged, including the packaging.
  • The Consumer bears the direct costs of returning the goods.


§6 Complaints

  • In the event of a defect in the goods, the Consumer may complain about the defective goods based on the provisions of the Civil Code.
  • Complaints are processed within 14 days of the complaint being submitted by the client.
  • Complaints can be submitted via traditional mail or electronically.
  • The Consumer may not withdraw from the agreement if the defect is insignificant.
  • If the product sold has a defect, the Consumer may also demand the replacement of the item with one free from defects or demand the removal of the defect.


§7 Personal data

  • The administrator of personal data provided by the Buyer while using the Store is OKO Beauty Hunter Limited Liability Company, based in Warsaw, NIP: 8992932678 Regon: 522746764 KRS 0000985628.
  • The Seller processes the Client's personal data to fulfill orders, provide electronic services by the Seller, and for other purposes specified in the Terms and Conditions. Data is processed solely on the basis of legal provisions or the Client's consent in accordance with applicable law.
  • The Seller protects the personal data provided to it and makes every effort to secure it against unauthorized access or use.
  • The Seller provides the Client's personal data to the Supplier to the extent necessary to complete the Delivery.
  • Providing Data by the Buyer is voluntary but necessary to place an order: first and last name or the name of the company/institution – necessary for issuing the sales document and addressing the shipment; address (street, house number/or house and apartment number, postal code, and city) – necessary for addressing the shipment; email – necessary for communication related to the fulfillment of the order; phone number – necessary when choosing certain delivery methods (required by suppliers).
